Bihar municipal poll: Review petition files in HC after declares quotas for illegal, hearing on October 19

PATNA: After declared as “illegal” reservation of seats for Other Backward Classes and Extremely Backward Classes for election to municipal bodies in Bihar. The state government has filed a review petition in the Patna High Court regarding the matter. The hearing on the petition will be held on October 19. Significantly, after the order of the Patna High Court, the State Election Commission had postponed the municipal elections.

The guidelines of the court were not implemented in Bihar

In the municipal bodies’ elections of Bihar, the guide line of the court regarding the backward reservation was not considered. The Patna High Court had termed the Most Backward Reservation in the civic elections wrong, after which the Bihar government had talked about going to the Supreme Court, but the state government on Monday filed a review petition against the ban on reservation in the Patna High Court.

The Bihar government was planning to move the Supreme Court against the decision of the High Court. But the government filed a review petition in the Patna High Court on Monday itself.

Municipal elections were announced in Bihar. The Election Commission had issued the notification and the dates were also announced. Voting for the first phase was to be held on October 10, while for the second phase the voting was to be held on October 20.

After getting the symbol, the candidates also got the banners and posters printed. But after a decision of the Patna High Court, the election was put on hold.

It was argued in the court that the order of the Supreme Court on reservation in this election has been disobeyed. The triple test required for reservation was not conducted. After the decision of the Patna High Court, the Bihar State Election Commission had postponed the municipal elections.
